Agreement

By accessing or using TAELON HOME PRODUCTS PRIVATE LIMITED, you agree to be bound by these Terms of Service. If you do not agree, please do not use the site.

Products and Pricing

All prices are in Indian Rupees (INR) and include applicable taxes unless otherwise noted. We reserve the right to modify prices and product availability at any time without notice.

Orders

Placing an order constitutes an offer to purchase. We reserve the right to refuse or cancel orders in cases of suspected fraud, product unavailability, or pricing errors.

Shipping and Delivery

Shipping timelines are estimates. TAELON HOME PRODUCTS PRIVATE LIMITED is not liable for delays caused by carriers, customs, or events outside our control.

All content on this site — text, images, logos, product designs — is the property of TAELON HOME PRODUCTS PRIVATE LIMITED and protected by copyright.

Governing Law

These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.

Limitation of Liability

To the maximum extent permitted by applicable law, Taelon Home Products Private Limited ("Taelon", "we", "us", or "our"), operating the Unmukt platform at unmuk.shop, its directors, officers, employees, affiliates, agents, and licensors shall not be liable for:

  1. Indirect or consequential losses — any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation loss of profits, loss of revenue, loss of business opportunity, loss of data, loss of goodwill, or any other intangible loss, arising out of or in connection with your use of the Tryswivo website, products, or services, whether based in contract, tort (including negligence), strict liability, or any other legal theory, even if Taelon has been advised of the possibility of such damages.

  2. Aggregate liability cap — Taelon's total cumulative liability to you for any and all claims arising out of or relating to your use of the website, the products, or these Terms, regardless of the form of action, shall not exceed the total amount actually paid by you to Taelon for the specific transaction giving rise to the claim, or ₹5,000 (Rupees Five Thousand only), whichever is lower.

  3. Third-party services — any acts, omissions, errors, or failures of third-party service providers, including but not limited to payment gateways (Razorpay, Paytm, and similar), logistics and courier partners, telecommunication providers, internet service providers, or any other intermediary involved in the delivery of products or services. Taelon does not warrant or guarantee the performance of such third parties and accepts no responsibility for delays, losses, or damages caused by them.

  4. Force majeure events — any failure or delay in performance caused by events beyond our reasonable control, including without limitation acts of God, natural disasters, pandemics, epidemics, war, civil unrest, government action or restriction, regulatory changes, strikes, labour disputes, internet or power outages, cyber attacks, or any other event of similar nature.

  5. Use of products — any harm, injury, loss, or damage arising from your use, misuse, or inability to use the products purchased from the website, save and except where such harm directly results from a manufacturing defect for which a remedy is available under our Returns Policy or under the Consumer Protection Act, 2019.

Statutory rights preserved. Nothing in this clause shall exclude or limit any liability that cannot be excluded or limited under applicable Indian law, including liability for death or personal injury caused by Taelon's gross negligence, fraud, fraudulent misrepresentation, or any liability in respect of consumer rights under the Consumer Protection Act, 2019, the Sale of Goods Act, 1930, or any other applicable statute. Nothing in these Terms affects your statutory rights as a consumer.

You agree that the limitations and exclusions in this clause are reasonable, having regard to the nature of the transaction, the price paid for the products, and the practical impossibility of insuring against all forms of indirect or consequential loss.

Termination of Services

These Terms remain in effect until terminated in accordance with this clause. Termination may occur as follows:

1. Termination by you. You may stop using the Tryswivo website or close your account at any time. Closing your account does not relieve you of any obligations relating to orders placed before termination, including payment of amounts due, return of goods received under fraud or error, or compliance with applicable laws.

2. Termination by Taelon. We reserve the right, in our sole and reasonable discretion, to suspend, restrict, or terminate your access to the website, your account, or any service provided by Taelon, with or without prior notice, where we have reasonable grounds to believe that:

(a) you have breached any provision of these Terms, our Privacy Policy, our Refund Policy, our Shipping Policy, or any other policy published on the website;

(b) you have engaged in fraudulent activity, including but not limited to placing orders with no intention to pay, claiming false delivery failures, abusing return or refund rights, or chargeback abuse;

(c) you have provided false, inaccurate, incomplete, or misleading information at registration, checkout, or thereafter;

(d) your continued use of the website would cause Taelon to violate any applicable law, regulation, or order of a competent authority;

(e) you have engaged in any conduct that disrupts the operation of the website, harms or threatens to harm other users, infringes the intellectual property of Taelon or any third party, or otherwise damages the goodwill or reputation of the Tryswivo brand;

(f) we are required to do so by a court order, regulator, or government authority.

3. Termination for convenience. Taelon may also discontinue, modify, or terminate the website or any service offered through it, in whole or in part, at any time and for any reason, by posting notice on the website or by other reasonable means. Where practicable, we will provide reasonable advance notice of any such material change.

4. Effect of termination. On termination of your access or account:

(a) any order placed by you that has been accepted by Taelon and is in transit shall, where reasonably practicable, be fulfilled in accordance with these Terms; orders that have not yet shipped may, at our discretion, be cancelled and any payments refunded to the original payment method in accordance with our Refund Policy;

(b) any amounts due and payable by you to Taelon, including outstanding payments, shipping or COD charges, or amounts owed in respect of fraudulent or abusive orders, shall remain due and payable;

(c) your right to access the website, your account, and any associated services ceases immediately;

(d) Taelon may retain such information as is required to comply with our legal, tax, accounting, or regulatory obligations under Indian law (including the Income Tax Act, 1961, the Goods and Services Tax framework, and the Information Technology Act, 2000), even after termination.

5. Survival. The provisions of these Terms which by their nature should survive termination shall survive, including without limitation: Limitation of Liability, Indemnification, Intellectual Property, Governing Law and Jurisdiction, and any clauses relating to outstanding payments, refunds, or data retention.

6. No waiver. Taelon's exercise or non-exercise of any termination right shall not constitute a waiver of any other right or remedy available to it under these Terms or under applicable law.
